Temporary Rules

Expedited Emergency Game and Fish Rules

Maximum of 18 months duration; must be reviewed by Attorney General’s office; Governor cannot veto
Minn. Stat. sec. 84.027, subd. 13(b)

set open seasons and areas
  • select hunters or anglers for areas
  • provide for registration of game or fish
  • prohibit or allow taking of wild animals to protect a species
  • prevent or control wildlife disease
  • prohibit or allow importation, transportation, or possession or a wild animal
  • set seasons for harvesting wild ginseng roots and wild rice and restrict or prohibit harvesting in designated areas
  • designate prohibited invasive species, regulated invasive species, unregulated nonnative species, and infested waters

Good Cause Exempt Permanent Rules

Limited purposes; 2-year limit if adopted under (a) or (b); review by administrative law judge
Minn. Stat. sec. 14.388

  1. address a serious and immediate threat to the public health, safety, or welfare
  2. comply with a court order or a requirement in federal law . . . (see statute)
  3. incorporate specific changes set forth in applicable statutes when no interpretation of law is required
  4. make changes that do not alter the sense, meaning, or effect of a rule

  • describe zone or permit area boundaries
  • designate fish spawning beds or fish preserves
  • select hunters or anglers for areas
  • provide for registration of game or fish
  • prevent or control wildlife disease
  • correct errors or omissions in rules that do not have a substantive effect on the intent or application of the original rule
  • designate prohibited invasive species, regulated invasive species and unregulated nonnative species
